The Allahabad High Court has ruled that the mother is the natural guardian of a child below 5 years old, and ordinarily, she should be given custody. The court dismissed an appeal by Amit Dhama, who contested a family court order giving custody of his 4-year-old daughter to his estranged wife. The high court stated that the mother's needs can better meet the physical, emotional, and psychological needs of the child.
