A federal judge in Texas struck down EEOC guidance aimed at protecting employees from workplace harassment based on gender identity and sexual orientation. Judge Matthew J. Kacsmaryk ruled that the guidance exceeded the EEOC's authority and was inconsistent with Title VII of the Civil Rights Act and Supreme Court precedent. The guidance, issued in 2024, had advised employers against using incorrect pronouns, denying access to appropriate bathrooms, and enforcing dress codes that discriminate based on gender identity.
