A judge ordered the restoration of a health monitoring program for coal miners in West Virginia and rescinded layoffs at a National Institute for Occupational Safety and Health (NIOSH) facility. The court acted following a lawsuit by a coal miner diagnosed with black lung disease, ruling that the federal government lacks authority to cancel the program. The judge mandated the reinstatement of surveillance and job transfer programs to prevent irreversible harm to miners' health.
