A federal appeals court has upheld a lower court's ruling to limit abortion pill sales in West Virginia, affirming a 2023 district court decision. Despite FDA approval, the 4th U.S. Circuit Court of Appeals ruled that a state abortion ban can override federal approval. This follows a 2022 Supreme Court decision (Dobbs v. Jackson Women’s Health Organization) that allowed states to enforce abortion restrictions.
