💨 Abstract

Foreign-born workers, about 20% of the U.S. labor force, often face uncertainty regarding their workplace rights. Employers cannot ask about specific immigration status but can inquire if applicants are legally authorized to work in the U.S. Undocumented workers may still have protections under certain employment laws. If mistreated based on perceived immigration status, workers can file complaints with the U.S. Department of Justice or EEOC, which investigate regardless of immigration status.
