💨 Abstract

The Constitutional Court of South Africa has ruled existing parental leave laws unconstitutional, finding they unfairly discriminate against fathers, adoptive, and surrogate parents. The court has ordered that parents can now share four months and 10 days of parental leave, regardless of gender or biological status. This change aims to balance work and caregiving responsibilities more equitably. The court has given Parliament three years to amend the relevant laws, with immediate implementation of shared leave provisions.
