💨 Abstract

A Virginia judge ruled that prosecutors cannot use a recorded interview with the daughter of IRS agent Brendan Banfield, charged with murdering his wife and another man. The judge, Penney Azcarate, sided with the defense, stating the interview didn't fall within the statute allowing child interviews as evidence. Additionally, Banfield's attorney moved to dismiss his indictment and remove the lead prosecutor, arguing they manipulated a co-defendant's interview.
